DC Court of Appeals Rules for Fireplace Industry

I know we sent out an email announcing the D.C. Court of appeals decision in favor of the HPBA over the U.S. Department of Energy, but good news bears repeating! Please see www.SaveGasLogs.com to read the Court’s opinion and learn about the history of the issue with the DOE. We’ll keep you posted if the DOE attempts any new rulemaking and, rest assured, we’ll fight any unreasonable regulation of the products we make and you sell.

We now have daily pickup service from FEDEX, in addition to UPS, for orders too small to ship via LTL or Truckload.

You may specify your preference of carrier (FEDEX or UPS) on your purchase order. If you do not, we will select the carrier. FEDEX has an earlier pick-up time from us than UPS, so sometimes which carrier we choose will depend on what time it is when we complete production of your order.

One advantage of shipping by FEDEX to residences is that they deliver on Saturdays at no additional cost with their FEDEX-HOME service.

Please contact us with your FEDEX account number if you wish to have your shipments third-party billed to your FEDEX account.

pic5Members of HPBA should have received their ballot for HPBA Board of Directors. Rett Rasmussen was asked by Jack Goldman, President & CEO of HPBA, to place his name in nomination, and Rett agreed. Here is the biography Rett submitted:

“Rett Rasmussen has been Vice President of Rasmussen Iron Works, Inc., a Whittier, California-based manufacturer of fireplace gas log sets and infrared gas grills, since 1987. He is a Certified Gas Engineer from the American Society of Gas Engineers and has been a member of various working groups and committees dealing with standards development and regulatory matters relating to gas logs and fireplaces. He has attended every HPBExpo since 1986.

Rett has a BS from the U.S. Naval Academy and was a Surface Warfare Officer before joining Rasmussen. He serves on the Board of the Whittier Rotary Club, has been an Advisory Board Member for the Whittier Salvation Army, and is a Eucharistic Minister for his church. He has been married to Irene for twenty-two years, and is the father to Teddy (20) and Chris (17). He is an Eagle Scout, Assistant Scoutmaster, Corresponding Secretary for his USNA class and was a water polo goalie in high school and college. Rett enjoys hiking, working out and reading history and thriller novels.”

Save Gas Logs Update

Two items of interest in our struggle against the US Department of Energy (DOE) occurred on October 23. First, an article appeared in the Wall Street Journal (page A8) that featured Rett Rasmussen and chronicled the impact of the DOE’s action against gas fireplaces and gas logs on Rasmussen and the industry.

Also on that day, a bipartisan group of members of the U.S. House of Representatives introduced legislation (H.R. 6578) that would define in federal law “decorative hearth products.” Sponsored by Representatives Cathy McMorris Rogers (R-WA), Linda Sanchez (D-CA) (Rasmussen’s Congressional Representative) and John Kline (R-MN), H.R. 6578 would amend the Energy Policy and Conservation Act by defining decorative hearth products as gas fireplaces, stoves, fireplace inserts and gas log sets that are not designed or intended to produce heat. This definition would remove decorative hearth products from under the regulatory umbrella of DOE.

pic5Preparing for the Next Disaster

An email we received the day after Hurricane Sandy hit, from Bill R., Linthicum Heights, MD, pointed out the value of a Rasmussen gas log set:
“Our power was knocked out yesterday evening by hurricane Sandy and we used our Rasmussen unit today to stay warm and even do a little cooking. It was a big help to have the unit which didn’t need electricity to operate.”

You can help your customers prepare for the inevitable next disaster in a couple of ways.

  1. Provide them with a Disaster Kit check list (download here one you can add your brand to);
  2. Advise them of the benefits of having a gas log set in at least one fireplace in the home.

Gas log sets are an excellent source of emergency heat for when the power goes out. Hurricane season may be subsiding, but ice storms are coming. “Be Prepared” isn’t just for Boy Scouts.

The new prices are effective for all orders placed on or after September 1, 2012. The new prices reflect price changes that range from 1% to 5%, depending on item, in order to meet the rising cost of business from increases in raw materials, components, labor, freight, insurance, etc.

The new list has been reformatted to include vented burner/lighting control combinations (factory assembled), making it easier for you to arrive at the proper price. They are arranged by control type (Match Light; Manual; Remote Ready; Variable Remote; Millivolt; and Valve Vanisher with EIS and Millivolt). There is still a-la-carte pricing for the individual burners and controls. The rest of the list have been grouped into product categories. Be sure to use the Table of Contents on Page 1 to find what you need. We will also have a familiarization video available to assist you in using the new price list, which will be available on Tuesday, August 7, at http://bit.ly/LogPriceList

Advertising products at MSRP helps to maintain the Rasmussen legacy as a top producer and serves to protect the reputation of our brand image, name and products. MAP policy only limits the prices at which Rasmussen products may be advertised and does not extend to the prices at which Reseller actually sells Rasmussen products, which are at the sole discretion of the Reseller.

Boat Mounts for Solaire Anywhere and Everywhere Grills

In the last newsletter we reported that we discontinued the Rail Mount and Square Post Adapter for our Solaire Portable Grills. In their place, we recommend using the SOL-170BR Adapter Plate with many of the rail, deck and fishing pole mounts offered by Magma Products, which are available at leading boating and online retailers. This combination greatly increases the options for the boater who wishes to use a Solaire Anywhere or Solaire Everywhere on his boat.

Update on Evin's Ride – Mission Accomplished!

In the past two newsletters we told you about Capt. (SEAL) Evin Thompson, USN (ret.),  and his bike ride across the USA on the TransAmerica Bicycle Trail. Evin, who is Rett Rasmussen's Naval Academy classmate and water polo teammate, retired in April after thirty years of active duty and commenced on the bike ride of a lifetime on May 1. On July 11, 2012, after 72 days and 4639.8 miles, Evin arrived at Victory Monument in Yorktown, VA, to complete his ride.

Evin dedicated each day of his ride to a fallen SEAL or support hero who has made the supreme sacrifice since 9/11/01. He dedicated the last day of his ride to all of the SEALs, boat operators and Naval Special Warfare combat enablers who will give their lives in the future in the security of our nation. Per Evin: "While our nation has remained secure during the last 10+ years, it has only been so because of these men and the other members of the Department of Defense, the other federal agencies and our domestic law enforcement and first responders. The threat to America is real, but it is brave men and women that face danger every day who will maintain the freedom and security of America for years to come."

We have updated our Solaire Price list to reflect the materials offered for our grill covers. Most of our covers are now made of a heavy duty material called “UltraTexHyde” with an embossed Solaire logo, and are made in the USA. Prices of these covers have increased a bit. Those not identified below as UltraTexHyde will be upgraded at a later date once our inventory of the older materials is exhausted.

We have discontinued the Solaire SS Cleaner/Polish, due to a lack of sales. There are many acceptable options in the grocery aisle at a lower price.

We have added two styles of 36-inch built-in doors to complement our 36-inch Solaire Grills.

Are Gas Logs A Cure For Smoking Fireplaces?

(This information appeared in the June 2012 issue of Sweeping magazine as a technical article by Rett Rasmussen)

Q – Is a gas log set a cure for a smoking (non-drafting) fireplace?

A – Yes and no. Most sweeps have worked on a fireplace that, despite applying a cap, trimming back trees, lengthening the stack and many other tricks of the trade, they just can't seem to correct the drafting problem. Gas logs come to mind as a possible solution, but which kind you use can either continue the problem or provide a viable solution for providing a flame in the fireplace.

June was a busy month in the industry's efforts to right the wrongs created by the US Department of Energy in their "Rulemakings" of April 2010 and November 2011.

The DOE sought to bring Decorative Hearth Products under their regulatory control. While Gas Logs was momentarily reprieved, Decorative Gas Fireplaces are the subject of the lawsuit by HPBA on behalf of our industry (and joined by National Propane Gas Association). On June 1, HPBA received notice that oral arguments would be heard on September 11, 2011, by a three-judge panel of the DC Court of Appeals. On June 20, HPBA and NPGA filed the “Petitioners’ Joint Reply Brief” (http://bit.ly/Lbn6ev) , which is the last of the truly substantive filings in the proceeding. Two largely administrative filings remain, the last of which is due on Thursday, July 5th.

So, on 9/11 while you are honoring those who perished eleven years prior in the attack, please say a prayer for our industry as HPBA and NPGA argue before the Court on our behalf.

By the way, if you are not a member of HPBA, and you derive any portion of your income from gas fireplaces or gas logs, please join at http://bit.ly/join-hpba. HPBA is doing what it does best right now, which is to fight for our industry. As of early June, the various governmental issues currently being fought by HPBA have cost in excess of $2 million, with half being shouldered by manufacturers. All in the industry need to participate in funding these efforts, as the threats are numerous and costly. In the immortal words of Benjamin Franklin, at the signing of the Declaration of Independence: “We must, indeed, all hang together, or assuredly we shall all hang separately.”

(What it is and why we need your fireplace and grill lifestyle photos)

Pinterest is a social photo sharing network that is the fastest social network to break through 10 million unique visitors. In March 2012 it became the third largest social network, surpassing Linkedin and Tagged. 85% of users are women.

Embracing Pinterest is a means of driving traffic to our website. Each photo that is “pinned” links back to the source (our websites). Also, photos on Pinterest can be shared via Facebook and Twitter, expanding further the audience for our photos, and therefore our websites and products.

Pinterest's mission is to "connect everyone in the world through the 'things' they find interesting". Therefore, photos that are interesting are more likely to become pinned. Lifestyle photos are of high interest, especially living room photos of the gas log set in action; attractive outdoor kitchen layouts; and photos of food (especially with the grill in the background). Photos with people in them are extra-interesting. This is where you come in. Please send us your lifestyle photos.   We will properly attribute them to you, which provides you with valuable back links to your website to improve your search ranking. More interesting photos will increase traffic to our websites, which means more people will be visiting our dealer search (please make sure your contact information is accurate). Update on Evin's Ride

    NEW– Valve Vanisher™ with Millivolt Standing Pilot Control
 
We have now applied a millivolt control valve to the Valve Vanisher™ for nine different burner styles, with sizes from 15" to 30".

The Millivolt Control System derives its power to operate from the standing pilot and thermo-generator. After manually lighting the pilot, it provides ON and OFF control from the switch installed on the front. It can also be operated from a wall switch, wall timer, or wireless remote control (all sold separately). Millivolt Controls are compatible with home automation systems, exhaust fans and automatic dampers. The Millivolt Control provides a lower cost alternative to the Electronic Ignition System that is also available with the Valve Vanisher™. For more information simply reply back to this email.

One of the best free computer "tools" you can have is Dropbox. Dropbox is cloud storage that lets you access the files in your Dropbox from your computer, phone, iPad and the Dropbox website. It is also great for sharing files with others, especially files that are too large to email.

I use a MacBook Pro as my primary computer. With its dual processor, I installed VirtualBox so I can run Microsoft XP (for using Quickbooks) as well as the Mac OS (for doing almost everything else). I had a hard time figuring out how to move files from the "PC side" to the "Mac side", and vice-versa. Dropbox was the answer. I save everything that I do on the PC side to Dropbox. Within seconds, it is available to the Mac side. It is amazingly simple, yet powerful.

I like to read and listen to audio books in order to stay up on trends and to grow as a person, business owner and leader. In this new feature, I will share with you books I have enjoyed and found valuable to me and my business.

The Thank You Economy by Gary Vaynerchuk

Gary has been called the Jim Cramer of marketing. He grew his dad's liquor store into a $60 million/year business selling wine on the internet, at www.winelibrary.com. The Thank You Economy is about the effects of social media on business, but with emphasis more on "social" than "media". Gary does not claim to be a techie, so don't think that he has some fancy algorithm or script that will immediately transform your business. To the contrary, he thinks that the internet has changed the world into a "great big small town" and that your great-grandparents would be better suited for business in the next fifteen years than today's youngsters. Back in the day, business was conducted face to face, building trust, protecting your reputation by providing superior products and services, and going the extra mile to keep customers happy. Business was upfront and personal, and poor service or products was reported to friends at the country club, trade union or PTA. During the 1950s through the 1990s, big marketing dollars filled the airwaves, influenced buying decisions and crowded out the competition. Quarterly profits became more important than principles. But the internet is the great equalizer. It has given power back to the consumer, requiring a level of customer service from businesses not seen in decades. "Social media" is not just having a Facebook page or a Twitter handle, it's providing one-on-one attention scaled to your entire customer base. What's old is new again – doing business with the personal touch of our great-grandparents' time will serve us better going forward than the impersonal, "press 2 for customer service", way that many businesses have gone.

Most specialty retailers that we deal with "get" personal service with their customers. To some, The Thank You Economy will be a validation of the culture that already exists in their business. But for all of us, Gary Vaynerchuk reminds us that manners are always in fashion; that people want to do business with those they know, like and trust; and that happy customers are worth a lot more than any other kind. And businesses who do not connect with their customers via social media jeopardize the future and existence of their very business. The Thank You Economy will give you a good shove into using social media for your, and your customers', benefit.

I have seen Gary speak at two Infusionsoft conferences. He is lively and full of zingers. I actually listened to The Thank You Economy on audio book. Gary narrates the book himself and goes off-script often to add interesting asides and updates to the book since the time it was written. It made my drive into work pass quickly for a couple of weeks – learning while being entertained, a great combination!

pic5Rett Rasmussen has been appointed to the Technical Advisory Committee of the National Chimney Sweep Guild (NCSG).

Rett will answer NCSG members' questions regarding Gas Logs and Control Systems, but will also assist with questions on gas grills, industry issues and marketing and business best practices. He will also contribute articles to Sweeping, the NCSG's monthly magazine.

There are many misconceptions about infrared grills on the market. We call these "Infrared Myths":

  1. Small burners or blocked ports are good.
  2. Round rod grilling grids are desirable.
  3. You can change a conventional grill into an infrared grill.
  4. Infrared burners are only good for searing.
  5. Infrared is all the same, I'll just buy the cheaper one.

The next action will be a response from DOE, eventually leading to arguments before the Court of Appeals. Stay tuned…

pic5On April 20, 2012, my wife, Irene, and I were privileged to attend the retirement of Evin Thompson, my Naval Academy classmate and water polo teammate, after thirty years as a US Navy SEAL. On May 1, he embarked on a cross-America bike ride (the peddling kind), traveling from Astoria, OR, to Yorktown, VA (that will be over 4200 miles). Evin is dedicating each day of his ride to a fallen SEAL or boat operator hero who has made the supreme sacrifice since 9/11/01. In less time than it would have taken you to check your bags and make your way through the security check, Rasmussen presents two videos that explain the products that we showed at this year's HPBExpo in Atlanta, GA. Rett Rasmussen walks you through our various gas log sets, vented and vent-free; discusses the various control types; provides sales and design nuances of the various products; and provides a quick overview of the new "Valve Vanisher™" system, which is applied to nine of our vented burner styles, and helps you avoid "Big Ugly Box Syndrome."

Rett also walks you through our outdoor products, including FirePit logs, Solaire Infrared Grills and Bromic Radiant Patio Heaters that we displayed at the show.

    Dealer Interviews a Hit!

A quarter of our booth at HPBA was devoted to videoing dealer interviews. Google, in their latest search algorithm, provides high priority to video with relevant local content. This makes sense, because Google owns YouTube.

The interviews, conducted by our marketing coach, Edward Earle, were of business owners talking about what they know best – their hearth and outdoor products businesses. What is more relevant than that!

This effort by Rasmussen was a continuation of our Dealer Business Alliance, which is committed to providing dealers with the tools and knowledge to help dealers improve their businesses.

    HPBExpo 2013 – Change of Venue
 

feedback bosHPBA was informed in early January that the new Music City Convention Center n Nashville, TN would not be completed in time for the March 2013 show.

HPBA found that Orlando was available, and the Board of Directors voted to hold the show there March 13-16, 2013.

We know it's a year away, but what do you think of Orlando? Do you think that you will attend?

 


    NEW– Valve Vanisher™ with EIS
 
Rasmussen has created the Valve Vanisher ™ as the solution to three main issues with Electronic Ignition Systems installed inside the fireplace:

              1. The "Big Ugly Box"
              2. The Big Ugly box requires that the gas log set be downsized in order to center the set; otherwise, the log set is off-centered. Either way, the aesthetics of the gas log set and fireplace are less than desirable.
              3. The components are very heat sensitive.

              With the Valve Vanisher, Rasmussen has taken the components of the Big Ugly Box and located them underneath the gas log set. The VV raises the log set up just 2 5/8". The control valve is located on the right, and the control module on the left; both are in cool zones proven by extensive testing.

                "Save Gas Logs" Latest News
               

              pic5The Battle is Won, but the War Still Rages On.

              We've won a battle to save gas logs, but the war rages on. Late on November 9, 2011, the US Department of Energy (DOE) gave notice that they will publish a Final Rule to their July 22, 2011 Notice of Proposed Rule in the Federal Register in the near future. Whereas the DOE desired in July to impose four specific restrictions on vented gas log set (eliminating standing pilots and requiring all gas log sets to be listed to ANSI Z21.60 standard being the most damaging), the Final Rule imposes no such restrictions on gas log sets. It does place four restrictions on vented decorative gas fireplaces, but these had been proposed by our industry during previous negotiations with DOE.;

              It is evident that the testimony that Rasmussen and others provided directly to DOE, and the comments that gas log supporters submitted to DOE and their congressional representatives had impact on the DOE's Final Rule. Congratulations and thanks to those who participated in fighting for vented gas log sets.

              We used the webinar-type format with slide show and audio. We had a few technical glitches but powered through them to deliver relevant and timely information to help improve your business.

              Guest speaker Lee Sweeney of ACG Technologies spoke about recent changes to the Google search algorithm that favors local dealers like you and ways that you can take advantage of these developments. Signing up for and fine tuning Google Places is a no cost (just your time) first step. Lee spoke about "Mobilization" and how important it is to optimize your website for mobile smart phones. In fact, Google can tell if a user is searching from a mobile device, and favors serving up websites that are mobile optimized. Lee also spoke about updating your website to keep it relevant and fresh, just like your physical store.
